Indefinite Leave to Remain, commonly referred to as ILR (also known as “settlement”), allows a person to live in the United Kingdom on a permanent basis. It grants the holder the right to work or study without restriction and to access state benefits for which they qualify. Obtaining ILR provides long-term stability and security, ensuring that an individual’s residence in the UK is no longer dependent on immigration conditions.
If you are considering applying for ILR, or require assistance with the process, the specialist solicitors at Lexmark Legal can advise you at every stage. We fully appreciate the importance of ILR for your future and will guide you carefully through the process to minimise difficulties and ensure the strongest possible application.
ILR can be acquired through several routes, depending on the applicant’s circumstances:
- Work and family routes: Many applicants become eligible after five years’ continuous residence on an eligible work or family visa.
- Long residence route: Those who have lived lawfully in the UK for a continuous period of ten years may apply under the long residence provisions.
- Private life route: Individuals who have resided in the UK for 20 years, even where part of that time was without leave, may be able to apply on private life grounds.
- Immediate settlement: In limited cases, such as certain adult dependent relatives, ILR may be granted immediately on arrival.
In most applications, but not all, the applicant must meet the English language requirement and pass the Life in the UK Test.
